Welcome to MDH Trucking & Hauling, LLC. These Terms of Service (the "Agreement") govern the relationship between MDH Trucking & Hauling, LLC ("Carrier") and the entity requesting services ("Shipper"). This professional logistics agreement ensures transparency, reliability, and security for every haul we undertake.
1. Definitions
In this Agreement, the following terms apply:
- Carrier: MDH Trucking & Hauling, LLC, responsible for the physical transportation of goods.
- Shipper: The party, person, or entity at whose request the transportation is provided.
- Consignee: The party designated by the Shipper to receive the freight.
- Freight: Goods, commodities, or materials tendered for transportation.
2. Quotations and Payment Terms
All pricing is provided based on the specific requirements provided by the Shipper at the time of quotation. MDH Trucking & Hauling, LLC adheres to the following payment protocols:
- Standard payment terms are Net 30 days from the date of invoice unless otherwise agreed in writing.
- Late payments are subject to a 1.5% monthly interest fee.
- Quotations are valid for 15 days and are based on the weight, dimensions, and descriptions provided.
3. Carrier's Liability
MDH Trucking & Hauling, LLC operates under the regulations of the Carmack Amendment (49 U.S.C. § 14706). Our liability for loss or damage to cargo is limited as follows:
- Liability is capped at $100,000 per shipment unless additional valuation is declared and purchased in advance.
- Carrier is not liable for loss or damage caused by Acts of God, public enemies, authority of law, or the inherent vice of the goods.
- No liability is assumed for specialized equipment if the Shipper fails to provide adequate loading/securing specifications.
4. Freight Claims Process
Professional claims resolution is a hallmark of our reliability. To process a claim, the following conditions must be met:
- Claims for visible damage must be noted on the Bill of Lading (BOL) at the time of delivery.
- Written notice of claim must be submitted to info@mdhhauling.com within 9 months of delivery.
- Salvage must be preserved until the claim is resolved.
5. Warranties of the Shipper
The Shipper warrants that all goods are properly marked, labeled, and packaged for safe transportation. The Shipper is responsible for compliance with all applicable DOT regulations regarding hazardous materials and weight limits.
6. Governing Law and Jurisdiction
This Agreement and all services provided by MDH Trucking & Hauling, LLC shall be governed by the laws of the State of Florida. Any legal action arising from these terms shall be settled in the courts of Columbia County, Florida.
